Important information about traffic police fines

The maximum amount of monetary payments for violating traffic rules is 50 thousand rubles. The payment period is 60 days. It is considered from the moment the decision entered into legal force. The offender (driver, owner of the vehicle) is given a 10-day period to appeal this decision.

If we are talking about a “chain letter” (sent when a violation is videoed and photographed), then the payment period begins to count from the moment the violator receives it in person.

About the possibility of receiving installments

The maximum installment period that is provided to the violator to pay the traffic police fine is 3 months. It can be obtained by citing a difficult financial situation.

About the consequences of non-payment

At the end of the 60-day period, the traffic police officer waits an additional 10 days. This time is allocated for processing last-minute payments. If the fine has not been paid, the case is transferred to the Bailiff Service (Bailiff Service). A case is also initiated under Part 1 of Article 20.25 of the Code of Administrative Offenses of the Russian Federation and sent for consideration to the court.

Failure to pay a fine will result in one of three penalties:

About the “burning out” of fines

The fine “expires” after 2 years after receiving the “chain letter” and the absence of any additional actions on the part of the SSP. Monetary punishment does not disappear anywhere if the defaulter hid from the bailiffs for the specified time. Appealing a traffic police fine for violating traffic rules

Resolutions of traffic police officials on traffic fines are appealed according to the rules of Chapter 30 of the Code of Administrative Offenses of the Russian Federation. Two appeal procedures - extrajudicial and judicial - can be used at the discretion of the applicant. When first filing a complaint with a higher authority, if the results of the review do not satisfy the applicant, he has the right to go to court a second time. In this case, the decision on a fine made by the official and the decision on the complaint considered by his supervisor may be appealed to the court within ten days. Until the court makes a decision based on the results of consideration of the repeated complaint, the decision to impose a fine is considered not to have entered into legal force. That is, the subject held accountable is not obliged to fulfill it. When appealing, accordingly, neither the period for paying the traffic police fine nor the statute of limitations for the execution of the punishment provided for by the Code of Administrative Offenses begins to run.

Deadline for paying traffic police fines for traffic violations

A fine for violating traffic rules issued by a traffic police officer must be paid within sixty days. The calculation of this period begins from the date of entry into force of the decision to impose punishment. The obligation to pay is assigned to the person in respect of whom the relevant decision was made.

If, after the decision is made, the person fined applies to the administrative body that made the decision with an application for an installment plan (deferment) of execution and his request is granted, then the deadline for paying the fine should be calculated from the date of the end of the installment plan (deferment).

In order to prevent delays in fulfilling the payment obligation, it is important to calculate the date the resolution enters into legal force.

So, if the legality and validity of the resolution is not disputed, then it enters into legal force after ten days following the date of delivery or receipt of a copy of the resolution by the citizen brought to justice (Clause 1 of Article 31.1, Part 1 of Article 30.3 of the Code of Administrative Offenses of the Russian Federation ).

The same period is given for appealing the decision made by the court and imposing the punishment, as well as for a complaint upheld during its first consideration. If the above acts were appealed to a higher court, and based on the results of its consideration, the complaint was rejected, then the resolution comes into force immediately after its decision is made by the last court (Clause 3 of Article 31.1 of the Code of Administrative Offenses of the Russian Federation).

A progressive norm of administrative legislation that makes it possible to halve the size of a traffic fine imposed by the State Traffic Safety Inspectorate, from the point of view of the legislator, is: the possibility of paying the fine no later than 20 days from the date of its imposition. Exceptions to the offenses listed in Chapter 12 of the Administrative Code, which provide for a half-discount, that is, 50 percent, are:

  • traffic violations related to the transfer of control and driving a vehicle while intoxicated (Article 12.8);

  • violation of the speed limit by exceeding more than 60 km. /ch., committed repeatedly (part 7 of article 12.9);
  • violation of traffic light rules when driving against a prohibiting signal, committed repeatedly (part 3 of article 12.12);
  • departure and movement along the oncoming lane of automatic transport vehicles and trams (part 5 of article 12.15);
  • moving towards the traffic flow along a road lane intended for one-way traffic of automatic vehicles (part 3.1 of article 12.16);
  • violations of traffic rules of the Russian Federation that resulted in harm to health and do not constitute a crime (Article 12.24);
  • refusal of the vehicle driver to undergo a medical examination, which does not constitute a crime (Article 12.26);
  • violation by the driver of the vehicle, participant in the accident, of the prohibition on the use of alcohol and other substances, as well as the use of such after stopping the vehicle before undergoing a medical examination (Part 3 of Article 12.27).

The key condition for applying a fine with a 50 percent discount is determining the moment from which the grace period begins. The start of the deadline for paying a fine for violating traffic rules with a 50 percent discount coincides with the date of the traffic police decision. Therefore, you can forget about appealing the discount decision, since the appeal procedure will take much more than 20 days.

At the same time, it is not prohibited to pay the fine in half and appeal the decision. If the traffic police fine was issued to the violator outside the twenty-day period, for example, due to unsatisfactory performance of the postal service, then there is no need to think about benefits. The same rule also applies to cases where the execution of the punishment was delayed or spread out at the request of the offender (Part 1, 1.3 of Article 32.2 of the Code of Administrative Offenses of the Russian Federation).

Statute of limitations for traffic police fines for traffic violations

The period during which a fine can be executed is two years. Its calculation begins from the date the resolution enters into legal force. However, you should not rejoice at those violators who, having demonstrated the art of resourcefulness, did not pay the administrative traffic fine. Evasion from execution of a monetary penalty by force of law interrupts the running of the two-year limitation period. In such cases, collection may last indefinitely. Unfortunately, the law does not define the concept of “evasion.” What is meant by this term? It seems to us that evasion from fulfilling any obligation, by analogy with criminal law, should be understood as any deliberate actions of an obligated person carried out by him in order to avoid fulfilling obligations.
Thus, if the fine for traffic violations was not paid due to other circumstances not related to evasion, that is, not intentionally, for example, due to illness, then it makes no sense to pay the traffic police fine after the expiration of the pretrial period.

If a violator of the Traffic Rules does not pay the fine within the prescribed period, then, starting from the day following the end of the two-month payment period, and over the next three months, he may be brought to administrative responsibility and given one of the penalties in the form of:

Will there be new fines for traffic violations in November? No! None of the sanctions in the table above take effect in November. And the new fines are a myth. This is relevant as of February 18, 2020, we monitor new information daily and are aware of upcoming legislative changes.

In fact, it is hyped every year by a number of publications and websites for reasons unknown to anyone. We have already published and even the year before last.

How can I check this?

It is logical to conclude that, although we write about a number of publications with news about increasing traffic police fines, we ourselves can be the same site, writing not entirely truthful data, without referring to the official website of the traffic police.

Therefore, we will refer to official sources, although the traffic police website actually has nothing to do with it. And what does it have to do with it?!

There are 2 ways to check whether this information is myth or truth:

  1. check for new fines from November 1 on the official website of the traffic police, as well as new laws from November 20, 2019 in legal information databases - that is, more authoritative sources,
  2. look for changes on the government website, where new traffic rules must be published.
  • on the website of the State Traffic Inspectorate, all the above amounts for administrative fines, including speeding, tinting, driving without compulsory motor liability insurance and others are the same as at the beginning of the year and even in the past,
  • Let’s also look at the Consultant Plus website - here there are all new editions of the Administrative Code, depending on the dates of changes that come into force; You won’t find any new traffic police fines here either, which come into force in November.

Did you know that every change and every new law must be officially published in government publications, including on the Internet? The second way is to check this.

But let’s first find out where the statement above comes from. This has been told to us since back in 1993, which also indicates on which website the changes are published.

There's only one small thing left to do - we go looking for new fines on the Pravo.gov.ru portal and don't find any federal laws there that were developed before November 2019. Thus, we receive “proof” that there will be no changes either from November 1 or from November 20.

But there is one new November penalty!

We indicated above that not a single new fine was introduced for traffic violations in November 2019. And it is true. And yet, one penalty will appear for violating the tachograph law from November 1.

This new change is being introduced within the framework of Federal Law No. 216 of July 26, 2019 and reforms the content of Article 11.23 of the Code of Administrative Offenses of the Russian Federation. In particular, new sanctions are being introduced for the absence of a tachograph in a car equipped with one, as well as non-compliance with the norms of work and rest time.
